Annahme der Bedingungen

By accessing or using the AI Mock Interviewer platform ("Service") operated by Aivium ("we," "our," or "us"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

Service Provider: Aivium, registered as a JDG (Jednoosobowa Działalność Gospodarcza) in Poland.

Service-Beschreibung

AI Mock Interviewer is a platform that provides AI-powered interview practice sessions, feedback, and analytics to help users improve their interview skills. Our Service includes:

  • AI-powered mock interview sessions
  • Real-time feedback and analysis
  • Performance tracking and analytics
  • Interview history and progress reports
  • Subscription-based access to premium features

Berechtigung

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use our Service. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Benutzerkonten

Kontoerstellung

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are solely responsible for all activities that occur under your account

Kontokündigung

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms or engage in harmful or illegal activities.

Abonnements & Abrechnung

Abonnement-Pläne

We offer various subscription plans with different features and usage limits. Subscription details, pricing, and features are displayed on our pricing page and may be updated from time to time.

Pricing

All prices are displayed exclusive of applicable taxes. Taxes (including VAT where applicable) will be calculated and added at checkout based on your billing address.

Abrechnungsbedingungen

  • Subscriptions are billed monthly in advance
  • Payments are processed securely through Stripe
  • Subscriptions renew automatically at the then-current rate unless cancelled through your account dashboard at least 24 hours before the end of the current period
  • We reserve the right to change pricing with 30 days' notice

Cooling-off Waiver for Digital Content

By purchasing our services, you request immediate performance and access to digital content. You acknowledge that you lose the statutory 14-day right to cancel under applicable consumer protection regulations once you begin using the service.

Rückerstattungsrichtlinie

Except where required by law, all sales are final and non-refundable. Once you access our digital services, refunds are not available.

You will retain access to premium features for the duration of your paid subscription period, even if you cancel your subscription.

Stornierung

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the end of your paid period.

Akzeptable Nutzung

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload or transmit harmful content (viruses, malware, etc.)
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the Service without permission
  • Share your account credentials with others
  • Use the Service to harass, abuse, or harm others

The Service, including all content, features, and functionality, is owned by Aivium and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

Benutzerinhalt

You retain ownership of content you create or upload ("User Content"). By using our Service, you grant us a limited license to use, process, and store your User Content solely for providing and improving our Service. We do not claim ownership of your interview recordings or personal data.

Datenschutz

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Service, you agree to our Privacy Policy, which is incorporated into these Terms by reference.

Haftungsausschlüsse

AS IS BASIS: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

NO EMPLOYMENT GUARANTEE: Our Service is designed to help improve interview skills, but we do not guarantee job placement, interview success, or employment outcomes.

AI LIMITATIONS: Our AI system provides feedback based on available technology and may not always be accurate or complete. Human judgment should always be used in conjunction with AI feedback.

Haftungsbeschränkung

To the maximum extent permitted by law, Aivium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Schadensersatz

You agree to indemnify and hold harmless Aivium from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of others.

Streitbeilegung

Geltendes Recht

These Terms are governed by the laws of Poland. For EU residents, you also benefit from the protection of mandatory consumer protection laws in your country of residence.

Streitverfahren

Before initiating formal legal proceedings, we encourage you to contact us atlegal@mockinterviewai.appto resolve disputes amicably. If informal resolution fails, disputes will be resolved through the competent courts in Poland, subject to mandatory consumer protection laws.

EU-Verbraucherrechte

EU Consumer Notice: Under EU law, you have a 14-day withdrawal right for distance contracts. However, by using our digital service immediately upon subscription, you expressly waive your right of withdrawal as permitted under Article 16(m) of the Consumer Rights Directive 2011/83/EU.

Digital Content: Our service provides digital content that is not supplied on a tangible medium. By subscribing and accessing the service, you acknowledge that the withdrawal period ends upon commencement of performance.

Kündigung

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately, and we may delete your account and data as described in our Privacy Policy.

Änderungen der Bedingungen

We may modify these Terms at any time. We will notify you of material changes via email or platform notification at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

Salvatorische Klausel

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
